By creating an account or using Unfurl.video ("Unfurl," "the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Unfurl is operated by Mitchell Runyon, currently operating as a sole proprietorship ("we," "us," "Unfurl").

2. Description of the Service

Unfurl accepts long-form video uploads and automatically transcribes them, identifies clip-worthy moments, and cuts short-form clips. Additional on-demand, per-clip features are available, including vertical reframing, AI-generated voiceover, burned-in captions, translation, AI-enhanced thumbnails, and platform-specific SEO copy generation. Features, processing limits, and clip-length limits vary by subscription plan as described on the pricing page at unfurl.video.

3. Accounts

• You must provide an accurate email address and create a password to use the Service. Passwords are stored using industry-standard hashing (bcrypt) and are never stored or visible in plain text.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Optional two-factor authentication (TOTP-based, with backup codes) is available and recommended for account security.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

4. Subscription Plans and Billing

Unfurl offers a Free plan and two paid subscription plans (Creator and Studio), billed monthly through Stripe, our payment processor. Current pricing and plan limits are published at unfurl.video and may change with notice. By subscribing to a paid plan, you authorize Unfurl to charge your payment method on a recurring basis until you cancel.

• You may cancel a paid subscription at any time; cancellation takes effect at the end of the current billing period unless otherwise stated at checkout.
• Unfurl does not store your full payment card details — payment information is collected and processed directly by Stripe.
• Refunds are handled on a case-by-case basis at Unfurl's discretion, except where required otherwise by law.
• Each plan has monthly video-processing limits and a maximum clip length; usage beyond your plan's limits may be blocked or require an upgrade.

5. Your Content

You retain ownership of the video, audio, and other content you upload to Unfurl ("User Content"). By uploading User Content, you grant Unfurl a limited license to store, process, transcribe, analyze, edit, and generate derivative clips, captions, translations, voiceovers, thumbnails, and text from that content, solely for the purpose of providing the Service to you. Unfurl does not claim ownership over your uploaded content or the clips generated from it.

You represent that you own or have the necessary rights to any content you upload, and that your content and its use through the Service do not violate any third party's rights or any applicable law.

6. Acceptable Use

You agree not to use the Service to:

• Upload content you do not have the rights to use or distribute.
• Upload unlawful, infringing, defamatory, or harmful content.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.
• Use the Service to generate content intended to deceive, defraud, or impersonate a real person without consent.

7. Third-Party Sub-Processors

Unfurl uses the following third-party services to operate the product. Uploading content or using the Service means your content may be transmitted to these providers solely to deliver the requested feature:

• Anthropic (Claude) — clip-detection analysis, translation, and SEO copy generation from your transcript.
• ElevenLabs — AI voiceover generation, when requested.
• OpenAI — thumbnail image enhancement, when requested.
• Stripe — payment processing and subscription billing.
• Cloudflare (R2) — storage of uploaded video and generated clip files.
• Supabase — hosting of Unfurl's database.

Video transcription itself is performed by a self-hosted transcription model operated by Unfurl, not sent to a third-party transcription API.

8. Intellectual Property

The Unfurl name, branding, website, and underlying software are the property of Unfurl and may not be copied, reproduced, or used without permission, except as necessary to use the Service as intended.

9. Termination

Unfurl may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service, or request account closure, at any time by contacting us (see Section 14). See our Privacy Policy for details on what happens to your data when your account is closed.

10. Disclaimers

The Service is provided "as is" and "as available." Unfurl does not guarantee that clip detection, transcription, translations, or any AI-generated output will be error-free, complete, or fit for any particular purpose. You are responsible for reviewing generated content before publishing it.

11. Limitation of Liability

To the maximum extent permitted by law, Unfurl and its founder shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Unfurl's total liability for any claim relating to the Service is limited to the amount you paid Unfurl in the twelve months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, and any dispute not otherwise resolved will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.

13. Copyright Complaints (DMCA)

Unfurl respects the intellectual property rights of others and expects users to do the same. If you believe content uploaded, stored, or processed through the Service infringes your copyright, you may send a written notice to mitchellrunyon23@gmail.com that includes:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material claimed to be infringing, and information reasonably sufficient to allow Unfurl to locate it;
• Your name, address, telephone number, and email address;
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
• A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Unfurl will review valid, complete notices and may remove or disable access to the identified material and/or suspend the accounts of repeat infringers. This is Unfurl's current best-effort contact point for copyright concerns; it does not represent a formal designated-agent registration with the U.S. Copyright Office.

14. Changes to These Terms

Unfurl may update these Terms from time to time. Material changes will be communicated by email or an in-product notice before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
